What is Workers’ Compensation Fraud?


Listed below are some of the ways a business might commit workers’ compensation fraud:

  • The employer does not report the total number of workers he or she has on his payroll

  • The employer falsifies his total gross payroll

  • The employer mis-classifies the employee’s job descriptions in order to insure them at a lower premium

  • The employer does not purchase Workers Compensation insurance at all

Employees, also have a variety of ways to commit fraud:

  • The employee claims a work related injury, when in fact the injury was incurred off the job

  • The employee claims a legitimate work related injury, but lies about the extent of the injury in order to collect benefits to which he or she is not entitled

  • The employee claims a work related injury when in fact no injury occurred

How does this fraud affect the citizens of Tulare County and the State of California?

  • It drives up premium costs for all businesses

  • It allows uninsured businesses to charge less for their services, making an uneven playing field for their competitors

  • It means employees may not receive medical care if injured on the job

What can you do to prevent Workers Compensation fraud?

  • Report fraud! Call the Tulare County District Attorney, Investigations Bureau at (559) 733-6600

  • Ask the businesses that you hire to provide proof of insurance coverage

  • Know your rights! If you are an employee and your employer asks you not to report an injury, or to seek medical attention, call our office
