On August 13, 2009, 32-year-old Timothy Lee Smith of Visalia was
convicted by a jury of four felony charges. Judge Kathryn Montejano
presided over the trial. After an almost two-week trial, the jury found
the defendant guilty of two counts of assault with intent to commit a
sex offense and two counts of attempted rape of an unconscious woman.
The charges stemmed from two separate incidents and involved two
different victims.
The defendant now faces up to 12 years in state prison as a result.
Sentencing in this matter is set for September 14, 2009 in Department 12
of the Visalia Courthouse.
The case was prosecuted by Deputy District Attorney Mikki Verissimo. It
was originally investigated by the Visalia Police Department. Further
investigation was done by DA Investigator Barry Silva.
