On April 7, 2008, Ulisces Aguilar of Pixley was convicted of Second Degree
Murder for the killing of Everado Marquez, of Pixley. The jury found him
guilty of Second Degree Murder, and also found true the special
allegation that the murder was committed for the benefit, in
association, or for the promotion of a street gang. The jury also found
true the special allegation that a principal in the case discharged a
firearm causing death or great bodily injury.
On May 6, 2004, Ulisces Aguilar accompanied Miguel Cisneros to the home
of Everado Marquez, where Cisneros shot Mr. Marquez six times with a 9mm
rifle. The shots hit Marquez in the head, neck, and right shoulder. He
was pronounced dead soon thereafter. Cisneros was identified leaving the
scene with Ulisces Aguilar. The firearm was later recovered in Aguilar’s
home, and found to be the murder weapon.
Cisneros was previously convicted of murder, and conspiracy to commit
murder. He was sentenced to Life Without the Possibility of Parole in
2006.
The penalty for second degree murder is 15 years to life in prison. The
penalty for Discharging the Firearm adds 25 years to life in prison.
Aguilar is therefore eligible to be sentenced to up to 40 years to life
in prison. Aguilar’s sentencing hearing was set for May 9, 2008, in
Visalia Court, Department 10.
This case was prosecuted by Deputy District Attorney Daniel Underwood of
the Tulare County District Attorney's Office and investigated by Tulare
County Sheriff's Office Violent Crimes Detectives Frank Arnold, Mario
Martin, and Gary Hunt.
