On March 12, 2007, defendant fired two shots from a Winchester 30-30 rifle from an oak grove near the intersection Whitney and Cypress in Woodlake. Off. Mendez overheard the shots as he turned the corner onto Cypress while on duty as youth development officer. Investigation of the shots fired led to discovery that the bullets had entered 569 W. Whitney traveled through the living room, and into the backyard of the home. The bullet continued through the fence of the victim, and became lodged in a door at 403 N. Walnut. Evidence located on scene linked the rifle to the defendant.

On March 28, 2007, Officers from the Tulare County Sheriff’s Department responded to the defendant’s home where they located a Honda Recon ATV. Records check for the Honda Recon ATV revealed that the ATV was stolen.

On June 12, 2007, Det. Phillips of the Woodlake Police Department executed a search warrant of the defendant’s home. Defendant was found to have multiple baggies of methamphetamine of a total weight of 6.3 grams. Found in the home was evidence of defendant’s possession of the narcotics for the purpose of sales. Also found in the home were a homemade silencer, ammunition, and nunchaku.

On June 10, 2007, arson was committed at Colvin Mountain by use of a marine flare. On June 16, 2007, California Fire Investigator Paul Marquez executed a search warrant on the defendant’s home. Inside the home, Inv. Marquez found two flammable devices.

Judge Sevier indicated a prison term of 10 years and 4 months for the charges against the defendant. Defendant’s plea results in two “strike” convictions under California Law. Judgment proceedings are set for May 1, 2008, at 8:30 am in Department 4 of the Tulare County Superior Court, Visalia division.
