TWO TULARE MEN SENTENCED FOR SHOOTING THAT RESULTED IN THE DEATH OF AN UNBORN CHILD


Ubaldo Ibarra and Eduardo Yanez of Tulare were both sentenced today for a gang related shooting that occurred on February 25, 2006 in the area of the 400 block of South West Street in Tulare. One of the victims, who was pregnant, was hit in the abdomen and as a result of the shooting lost her unborn child.

Yanez, 19, pled guilty to a felony violation of Penal Code section 664/187(a), attempted murder and Penal Code section 245(a)(2), assault with a firearm. He also admitted to special allegations regarding the personal use of a firearm and that the crime was done for the benefit of a criminal street gang. .

Ibarra, 20, pled guilty to two felony violations of Penal Code section 245(a)(2), assault with a firearm. He also admitted to special allegations regarding the personal use of a firearm, great bodily injury, and that the crime was done for the benefit of a criminal street gang..

Judge Gary Paden sentenced Eduardo Yanez to serve thirty one years and eight months in state prison for his crimes. Ubaldo Ibarra was sentenced to serve sixteen years and eight months in prison for his crimes. Both will also have to pay a restitution fines in the amount of $4,000. They will have to provide samples of their blood, saliva, and thumb and palm prints pursuant to Penal Code section 296, and they will both have to register as active participants in a criminal street gang. Yanez’s and Ibarra’s pleas will count as “strikes” under California law, and in the future, if either one of them commit any other felony, their sentence could be twenty five years to life. Both Yanez and Ibarra will have to serve eighty five percent of their sentence before being paroled.

The case was prosecuted by Deputy District Attorney Ralph Kaelble of the District Attorney’s Office Major Crimes Division and investigated by Detective Darron Altermatt of the Tulare Police Department.
